Terms of use
Last updated [__] 2026
The short version
- These terms apply to argnite.com, the Argnite portal and the Argnite services.
- If your company has signed an agreement with us, that agreement comes first.
- You decide to put cameras in your outlets, so you are responsible for using them lawfully, signs included.
- Iggy, forecasts and Loss watch can be wrong. Use them to decide where to look, not as the final word on anything or anyone.
- Customer recognition (face) is in beta, and each member must give explicit consent before they are recognised.
- Malaysian law applies.
1. About these terms
These terms are an agreement between you and [Argnite Sdn. Bhd.] (company no. [__]) ("Argnite", "we", "us"). They apply when you visit argnite.com, message us on WhatsApp, sign in to the Argnite portal, chat with Iggy on Telegram, or use Argus, Argnite Analyst or Iggy (together, "the services"). By using any of them, you agree to these terms.
If you use the services for your company, you confirm that you are allowed to accept these terms on its behalf, and "you" includes the company.
If your company has signed an order form or service agreement with us, that document governs the services and takes priority over these terms wherever they conflict. Our Privacy policy explains how we handle personal data.
2. Who can use Argnite
The services are built for businesses. You must be at least 18 and use them in the course of your work.
3. Your account
- Keep your sign-in details private, and tell us straight away if you think someone else has used your account.
- Your company's account admins decide who has access and what each person can see. You are responsible for what happens under your company's accounts.
- Keep the phone numbers in your call lists up to date. Argus can only call the numbers you give it.
- If you connect Iggy to Telegram, keep your Telegram account secure and disconnect it from the portal if you lose your phone. Anyone holding a connected Telegram account can ask Iggy what that account is allowed to see.
4. Cameras, staff and customers
You choose to monitor your outlets, so you are responsible for doing it lawfully. In particular, you must:
- put up clear signs telling customers and staff that cameras are in use;
- tell your staff in writing how Argus and Analyst are used, including Loss watch if you switch it on, and follow Malaysian employment law when you act on anything the services show you;
- point cameras only at counters and sales areas, and never at toilets, changing rooms, prayer rooms, staff rest areas or anywhere else people expect privacy;
- make sure you have a lawful basis under the Personal Data Protection Act 2010 for the data you ask us to process;
- respond to requests from people who appear in your footage or sales records. We will help you do this.
If you switch on Customer recognition (beta), you must also:
- ask members for explicit consent using the wording we provide (or wording your lawyer approves that says at least as much), as a separate checkbox that is unticked by default;
- not make joining your loyalty programme, or any reward, depend on that consent;
- not enrol anyone under 18, and never enrol your staff;
- say on your in-store signs that members who opted in are recognised;
- act on a member's withdrawal straight away. The portal does the deletion for you.
5. What the services can and can't do
Argus helps you notice problems sooner. It is not a security system, an alarm or an emergency service. A call may fail or arrive late if a phone is switched off, a network is down, or the Argus box loses power or internet. If anyone is in danger, call 999.
Iggy uses AI, and its answers can be incomplete or wrong. Check anything important before you act on it.
Forecasts are estimates. How much you prep and order is your decision.
Loss watch shows patterns that look unusual. A flag is not proof that anyone did anything wrong. Watch the clip and talk to the person before taking any action, and never accuse or discipline someone because of a flag alone.
6. Things you must not do
You must not:
- use the services to watch, track or identify people in ways the law doesn't allow;
- use Customer recognition to build watchlists or ban lists, to recognise anyone who isn't an enrolled member, or to monitor staff;
- try to identify individuals from footage beyond what the services show you;
- resell the services or give access to anyone outside your own business;
- reverse engineer, scrape or try to get around the security of the services, except where the law allows it;
- tamper with an Argus box, or move a camera so it points somewhere it shouldn't;
- send unlawful, abusive or harmful content through Iggy or WhatsApp;
- use the services to build a competing product.
7. Pilots, fees and new modules
Your order form sets out the pilot period, fees, payment terms and the outlets covered. Modules marked "New" or "Beta", or offered as a preview, may change, may be less reliable than the rest of the services, and may be withdrawn. If we plan to stop a module you pay for, we will tell you before it happens.
Customer recognition is in beta. Its matches can be wrong. Don't use it to make decisions that significantly affect a person, such as refusing them service.
8. Your data and ours
Your sales data, footage and anything else you give us remain yours. You allow us to use them to provide and support the services for you, as our Privacy policy describes.
We may use aggregated or de-identified data, meaning data that can't identify you, your outlets or any person, to measure and improve the services.
Argnite, Argus, Iggy, the Iggy character, our software, designs and content belong to us or our licensors. You may not use our name or Iggy without our written permission. If you send us suggestions, we may use them without owing you anything.
9. Equipment
Argus boxes we supply remain our property unless your order form says otherwise. Keep them powered, connected and somewhere safe, and return them when the services end. You are responsible for the cameras, network and POS systems you provide.
10. Services we don't control
Some features rely on services we don't run, such as your POS provider, WhatsApp, Telegram and the phone networks. Their own terms apply to your use of them, and we aren't responsible for their outages or changes.
11. Availability and changes
We work hard to keep the services running, but we can't promise they will always be available or free of errors. We improve the services over time. If a change would significantly reduce what you are paying for, we will tell you in advance.
12. Our liability
To the fullest extent the law allows, the services are provided "as is", and we give no promises beyond those in your order form.
We are not liable for indirect or consequential losses, lost profits or lost sales. We are also not liable for losses caused by alerts that were missed or late, calls that didn't connect, or decisions you made based on Iggy, forecasts or Loss watch.
Our total liability for all claims arising in any 12-month period is limited to the fees you paid us for the services in that period, or RM [__] if you haven't paid us anything.
Nothing in these terms limits any liability that the law doesn't allow us to limit, such as liability for fraud.
13. Your responsibility to us
If someone makes a claim against us because you used cameras or personal data unlawfully, or because you broke section 6, you will cover our reasonable losses and legal costs.
14. Suspending or ending access
You can stop using the services at any time, subject to your order form. We may suspend or close access if you break these terms, if your account puts other people at risk, or if the law requires us to. Where we can, we will warn you first and give you a chance to fix the problem.
When the services end, you can ask for a copy of your data within [30 days]. After that, we delete it as our Privacy policy describes.
15. Changes to these terms
We may update these terms. We will post the new version on this page with its date, and give customers at least [30 days'] notice of significant changes. If you keep using the services after the changes take effect, the new terms apply.
16. Law and disputes
These terms are governed by the laws of Malaysia. If a dispute comes up, please write to us first. We will respond within 14 days and try to settle it by talking. If that doesn't work, the courts of Kuala Lumpur, Malaysia, will decide it.
